Talentboom Privacy Policy

Effective July 26, 2018, Talentboom, LLC, a California limited liability company ("Talentboom" herein) has updated its Privacy Policy (herein after referred to as "Privacy Policy") as set forth herein. This Privacy Policy describes the terms of Talentboom’s commitment to your privacy with respect to the Website (defined below).

PLEASE READ THIS POLICY CAREFULLY. IT IS YOUR CHOICE WHETHER OR NOT TO PROVIDE PERSONALLY IDENTIFIABLE INFORMATION ("PII", AS DEFINED BELOW) TO TALENTBOOM. IF YOU CHOOSE TO DO SO, YOU ARE GIVING TALENTBOOM YOUR EXPRESS CONSENT TO USE, PROCESS, AND DISCLOSE YOUR PII AS SET FORTH IN THIS POLICY. IF YOU CHOOSE NOT TO PROVIDE YOUR PII TO TALENTBOOM, YOU MAY NOT BE ABLE TO USE THE WEBSITE.

1. DEFINITIONS:

The terms "Data Controller" or "Operator" refer to Talentboom.

"IP Address" means "Internet Protocol Address".

"PII" means personally identifiable information about a User collected online by the Operator from that User and maintained by the Operator in an accessible form, including any of the following:

(2) A home or other physical address, including street name and name of a city or town;

(3) An e-mail address;

(4) A telephone number;

(5) A social security number;

(6) Any other identifier that permits the physical or online contacting of a specific individual; or

"Registration" means that the User takes active, positive steps to communicate information to this Website.

"Seller" refers collectively to Talentboom and its agents, owners, affiliates, operators, and employees.

"URL" means Uniform Resource Locator.

"User" means a Visitor, Subscriber, Member or Customer (as defined herein) of the Website.

"You", "your" and other similar pronouns refer to any Visitor, Subscriber, Member or Customer (as defined herein) utilizing the Website.

4. NOTICE TO CALIFORNIA CUSTOMERS - YOUR CALIFORNIA PRIVACY RIGHTS

5. ABOUT THE PII THE WEBSITE COLLECTS

This Website routinely collects PII about its Users. PII is obtained in various ways, such as:

a. PII obtained from Registration. Online ordering via SSL encrypted communication provided by shopping cart services supporting merchant service companies like Visa and Master Card provides information to the Website but does not provide complete credit card numbers. In the process of online ordering, the customer provides, name, address, city, state, email address, phone number, CVV2 (back of card) number, and, occasionally a member password. You should consider all this information available to the Website. This information is used to deliver the product, but under the Terms of Use Agreement you also approve its use for general solicitation purposes.

c. Visitor Email Inquiries. Visitors who wish to communicate with the Website do so under two conditions: one, they give their permission for contact by the Website; two, they are subject to any ‘submission’ provisions of the Terms of Use Agreement, or this Privacy Policy. While your email address may or may not be used to solicit you, it is added to the Website's general solicitation database.

6. HOW THE PII MAY BE used

a. Generally. The Website uses the PII it collects for a variety of purposes. The legal basis for the Website’s processing of PII will depend on the specific context in which we collect it. The Website will retain PII for as long as it is needed or until it is removed pursuant to this Privacy Policy.

b. Third Party Service Providers. The Operator shares information, including PII, with our third-party service providers that it uses to provide hosting for and maintenance of the Website, application development, backup, storage, payment processing, analytics, and other services for it. These third-party service providers may have access to or process your PII for the purpose of providing these services for us. The Website does not permit its third-party service providers to use the PII that the Website shares with them for their marketing purposes or for any other purpose than in connection with the services they provide to the Website.

c. Compliance with Laws and Law Enforcement Requests; Protection of Our Rights. d. PII That is Not Shared. Credit card information or other financial information is not usually shared except as set forth in subsection 6.c above.

7. TRANSFER OF INFORMATION (GDPR)

PII the Website collects will be processed in the United States and possibly transferred to entities in other jurisdictions. BY PROVIDING YOUR PERSONAL INFORMATION TO US, YOU CONSENT TO ANY TRANSFER AND PROCESSING IN ACCORDANCE WITH THIS POLICY.

The Website is based in the United States. The European Commission has recognized the EU-U.S. Privacy Shield Framework as providing an adequate level of data protection for transfers of data to the United States. However, the Website does NOT currently participate in the EU-U.S. Privacy Shield Framework.

SELLER HEREBY INFORMS YOU THAT THERE ARE POTENTIAL RISKS TO YOU ASSOCIATED WITH TRANSFERRING YOUR INFORMATION TO THE UNITED STATES DUE TO THE ABSENCE OF AN ADEQUACY DECISION AND APPROPRIATE SAFEGUARDS. THESE RISKS INCLUDE THE RISK THAT YOU WILL NOT BE ABLE TO EXERCISE YOUR DATA PROTECTION RIGHTS UNDER APPLICABLE LAW TO PROTECT YOURSELF FROM UNLAWFUL USE OR DISCLOSURE OF YOUR INFORMATION.

The Data Controller reserves the right to make changes to this Privacy Policy at any time by giving notice to its Users on this page. It is strongly recommended to check this page often, referring to the date of the last modification listed at the bottom. If a User objects to any of the changes to the Privacy Policy, the User must cease using the Website and can request that the Data Controller remove the PII. Unless stated otherwise, the then-current privacy policy applies to all PII the Data Controller has about Users.
